Upbit's '3-month business suspension' finally overturned... Court rules "not intentional or grossly negligent"

The massive regulatory risk surrounding Upbit, the largest virtual asset exchange in Korea, has been resolved. As the court fully canceled the financial authorities' 3-month partial business suspension order, market uncertainty is expected to subside.
On the 9th, the 5th Administrative Division of the Seoul Administrative Court ruled in favor of the plaintiff in a lawsuit filed by Dunamu against the Financial Intelligence Unit (FIU) of the Financial Services Commission to cancel a partial business suspension order. It has been about a year since the sanction was imposed in February of last year that the court sided with Upbit.
The court clearly drew a line regarding the key issue of 'intentionality or gross negligence.' In particular, while regulations exist to block transactions with unregistered virtual asset service providers for transactions of 1 million won or more, the court determined that specific regulations were lacking for transactions under 1 million won. This effectively acknowledged the existence of a so-called 'regulatory void.'
The court also pointed out that financial authorities did not provide specific measures or clear guidelines required for Upbit. In such circumstances, Dunamu's implementation of its own response measures can be acknowledged, and it is difficult to conclude intentionality or gross negligence merely because the ex-post measures were insufficient.
This ruling is expected to have a significant impact not only on the cancellation of sanctions against one company but also on the overall virtual asset regulatory framework. This is because the court's decision is interpreted as an acknowledgment of 'practical limitations' regarding the previously ambiguous scope of Travel Rule application and anti-money laundering obligations.
The industry is paying attention to the possibility that this ruling will serve as a signal for the easing of regulatory risks. Especially given that Upbit is a central axis for market liquidity and price formation in the domestic market, the resolution of uncertainty is expected to have a positive impact on investor sentiment stability. Simultaneously, there is a growing consensus that regulatory authorities will also need to establish clearer standards in the future.
